These terms are the agreement between you and Bastro, the operator of the services at bastro.ai. They are written to be read. Creating an account or using the services means you accept them; if you are accepting for a company, you confirm you have the authority to bind it.
Updated 2026-09-28: Clause 05 now states the consent basis by lead type and adds the buyer obligations for public-record mortgage protection leads. Drafted 2026-10-14: Clause 01 names Phone enrichment and clause 06 restricts enrichment output to fraud prevention use (no marketing, telemarketing, lead generation, debt collection, or FCRA purpose); binding from the day Phone enrichment opens.
Bastro provides data hygiene services — TCPA litigator, DNC, and relocated-number scrubs run against the lists you upload — a marketplace for purchasing leads, and Phone enrichment, which appends phone numbers and emails from a data partner to lists you upload. Scrub verdicts are produced from third-party scrub data vendors, and each job's results are stored to your account as that job's report.
You are responsible for your credentials, for the accuracy of what you upload, and for having the right to upload it. You confirm that lists you submit were collected lawfully and that you are entitled to process the phone numbers they contain. Accounts are for businesses, not consumers.
The services are prepaid. You purchase credit packs at the prices published at bastro.ai/pricing; credits are denominated at $0.001 per credit and burn per input row for scrubs and per lead for marketplace orders, at the rates published on the pricing page at the time of the job or order.
Credits are non-refundable and they do not expire. They have no cash value, are not transferable between accounts, and are not redeemable for currency. What you buy with them, you keep: completed job reports and delivered leads remain in your account history.
A scrub verdict is a data lookup: it reflects what the vendor sources said about a number at the moment your job ran. Verdicts are provided as data services, not legal advice, and no scrub — including litigator scrubbing, which carries no statutory safe harbor — makes a calling campaign lawful or immunizes you from claims. Compliance with the TCPA, do-not-call rules, and state telemarketing law remains your responsibility.
Every lead sale is final. No returns, no refunds, no replacements, no dispute process. We price leads below prevailing market anchors precisely because we sell them on these terms, and the policy applies uniformly — to connected calls and wrong numbers alike.
What we commit to in exchange: every opt-in lead row carries its consent metadata — consent timestamp, IP address, and TrustedForm or Jornaya token — and an order never includes a lead you already own, enforced by the platform. Aged web leads sourced from a dialer carry no captured TCPA consent, and each such row is labeled dialer-sourced in the delivered file. If a delivery fails technically (a broken file, a failed download), we redeliver the same order; we do not exchange it.
Public-record mortgage protection leads carry no consent record. Each sale requires the buyer's attestation, recorded on the order, to live manual dialing only, to scrubbing against the National and state do-not-call registries, internal do-not-call lists, and TCPA litigator lists before contact, and to never implying affiliation with the borrower's lender or servicer.
You may not use Bastro to run calling or texting campaigns that violate the TCPA, FTC telemarketing rules, or state law; to contact numbers you have no lawful basis to contact; to harass, defraud, or deceive; or to resell, republish, or redistribute scrub verdicts or purchased leads outside your organization. You may not probe, overload, or reverse-engineer the service. We may suspend or terminate accounts for violations, and prepaid credits on a terminated-for-cause account are forfeited.
Phone enrichment output is licensed for fraud prevention only. Phone numbers and emails returned by Phone enrichment may not be used for marketing, telemarketing, lead generation, debt collection, or any purpose regulated by the Fair Credit Reporting Act, and you acknowledge this restriction on every run. We may suspend accounts that use enrichment output for any other purpose.
The services are provided "as is." We do not warrant that any data source is complete or current, that verdicts are error-free, or that leads will convert. To the maximum extent permitted by law, Bastro is not liable for indirect, incidental, consequential, or punitive damages, or for lost profits, and our aggregate liability under these terms is capped at the amounts you paid us in the twelve months before the claim arose.
You may close your account at any time; unused credits are not refunded on closure. These terms are governed by the laws of the State of Delaware, excluding its conflict-of-laws rules. If we change these terms materially, we email account holders before the change takes effect and update the effective date above. Notices to Bastro go to legal@bastro.ai. These terms, the privacy policy, and the data processing addendum at bastro.ai are the entire agreement. Effective 2026-09-28.
